   NEWTON TOWNSHIP MINUTES 09-11-2012

Newton Township Trustees met in regular session on Tuesday, September 11, 2012 @7:00 pm in the township meeting room at the fire department.  Those in attendance were:  John Phillips, Township resident; Larry Taylor, Road Maintenance Supervisor; Allen Deaver, Fire Chief; James R. Smith, Robert J. Stephenson, and Charles R. Elson, Township Trustees; Derek J. Dozer, Township Fiscal Officer.

Meeting was called to order by Smith at 7:00pm.

Pledge to the flag was led by James R. Smith.

Agenda was approved as read.

Minutes were approved as presented.

Public Participation:

None.

Fire Department Business:  Deaver reporting;

                *Reported that kitchen is expected to be at or lower than estimated cost.

                *All new replacement lights are in and we are expected to get 50% back on the project.

                *Discussion about dirt in flower beds with Taylor.

                *Monthly reports not submitted for run stats.

Trustees Reports:

                Elson

*Call from Bonnie Kelly on Pete Hope Lane at 10:20pm.

                *Cheryl Bryant complaining about ditch washing out driveway.

                Stephenson

*1/2 of fence down on Avalon.

                *5258 Heckel Drive.  Wisecarver called State again this morning and she said that boss will be getting back to her.  Matt Russell advised getting a legal opinion.

                *Don Hamp called about culvert on Slack Road near Jim White property, will advise to come to meeting if unhappy.

                *Kenny Adkins on Sunset called about right-of-way for cable of property owner.  This is not a Township road in the area in question.

                *Maysville Schools called about us assisting them with trimming trees and discussion ensued.  It was agreed by all that Township could assist if provided a hold-harmless type standard business agreement.  Trustee Smith stated that he received a similar call to the call which came in about the Township helping with trees for a firetruck being used for a repair to the school.

                *FEMA Grant – will need timesheets for specific dates.  Gave forms that need filled out and returned.

                *Someone called requesting Children At Play signs and a liability discussion and legal issues discussion ensued with the issue finally being tabled until more research is done.

                Smith

                *How is Malibu going?  Resident had taken down mailboxes and blocked ditch.

                *Discussion on chip seal to begin on 9/12/12.

                *Tree on Drain Street needs looked at and possibly cut down.  Taylor – Haven’t yet.

Old Business; nothing to report.

New Business; nothing to report.

Road Reports, Larry Taylor reporting;

                *Getting street and stop signs in order but someone keeps painting them.

                *Moxadarla chip seal is bleeding through.  Discussion on what to cover with ensued.

                *Cracks in Broadvue Circle are getting bigger and need to discuss what to do and when to communicate with residents in 2013.

                *Done with mowing shortly.

                *Need belt for center of bed estimating at $2,500 in repairs.

Smith made motion to fix sides on dump truck and replace belts, bearings and sprockets for a total not to exceed $4,500.  Stephenson seconded and all three agreed.

                *Waiting on belts and blades for chipper.  Will provide Value Part PO.

Fiscal Officer reports:

                *Updates on Paul Fisher and Gary Sterling past WC injuries.

                *Worker’s Comp recently completed audit of our books with no findings.

                *Resolution 9-11-2012 on charging a “tipping fee” was signed by all 3 Trustees and will be sent out by certified mail accordingly.  This is not a tax or a fee that would be charged to the 2 companies but a fee charged to those bringing waste materials into Newton Township as provided for in Ohio Revised Code.  The smell complaints in East Fultonham continue to come in.  The weight and cubic figures are already calculated out to give to the EPA and Health Departments so the total time for each company to calculate this fee should be less than 5 minutes a month at most.

                *Resolution was discussed and will be provided for Waltemire property issue at the next meeting.

                *Copies of the following notices were provided to each of the trustees;

                                Payment register, fund status reports, bank reconciliation, grass roots clippings.

All bills presented were deemed to be valid expenditures and were to be paid as presented.

The next regular township meeting will be held on Tuesday, October 9, 2012 at 7:00pm in the township meeting room.
